ASR Hip Settlement Program Announced

A number of unsubstantiuated report s have recently appeared in the mass media regarding settlement of the DePuy/Johnson and Jonson ASR hip litigation.

No settlement has been confirmed by the court or lead counsel in the litigation but ASR patients continue to suffer the consequences of the faulty device.

Walkup, Melodia, Kelly and Schoenberger has been among the law firms speartheading the litigation on behalf of the injured plaintiffs and is one of only three firms nationwide which has obtained a successful jury verdict against DePuy for these defective hips.

In 2009, Walkup Melodia lawyers filed the nation’s very first ASR lawsuit, a year before DePuy recalled the defective hip device. The firm now represents hundreds of ASR patients from across the United States.

Many DePuy ASR patients remain unrevised with the defective devices still in place.

A total of 35,000 devices were placed in U.S. patients between 2006 and 2010.

It is estimated that more than 18,000 Americans still have an ASR device in their body, and as many as 40 % may still need a revision surgery because of device related problems including elevated cobalt and chromium metal levels in their blood, chronic pain, loosening, metallosis, soft tissue irritation or other problems associated with the defective ASR metal-on-metal hip prosthesis.
