DePuy Recalls the Defective ASR Hip Implant

On August 26, 2010, DePuy Orthopaedics, Inc., announced a recall of its ASR hip implant device. The product recall included two defective models: the ASR XL Acetabular System and the ASR Hip Resurfacing System implanted in patients between 2005 and 2009. A total of 93,000 prostheses are affected by the recall.

DePuy had known for years that these products were defective and discontinued production and sales of the ASR hip replacements in 2009. The Walkup firm filed the first product defect case against DePuy in the United States in March, 2009 — almost 18 months before the device was recalled.

Patients with the DePuy hip implant have experienced symptoms that include:

  • Pain
  • Swelling
  • Cup loosening with audible popping
  • Difficulty walking

Friction caused by the metal-on-metal construction caused metal debris to spread into patients' bodies, resulting in elevated levels of cobalt, chromium and other metals in the bloodstream.

The Company's Response to Patient Problems

DePuy initially said that 12 percent of patients who received the ASR resurfacing device and 13 percent of patients who received the ASR total hip replacement would eventually need "revision surgery." Revision surgery is a painful and expensive process in which the defective ASR cup is removed and replaced with a different device. The most recent scholarly research now predicts the real numbers will be between 29 and 41 percent.

Patients who were implanted with this defective device are entitled to complete compensation – not just the amount DePuy decides to offer.
