Michael A. Kelly is one of the nation’s foremost experts in the prosecution of obstetrical injury claims on behalf of disabled children and their parents. He has handled cases arising from labor and delivery room mistakes, midwifery errors, negligent fetal hear rate monitoring, delayed cesarean section, abruption, uterine rupture and excessive use of labor inducing drugs ( Pitocin ).
His February 2010 $23,200,000 jury verdict in an obstetrical negligence/cerebral palsy case in western Minnesota is one of the largest jury results ever obtained in a birth injury case anywhere in the U.S. His record of success against Kaiser Foundation Health Plan and Permanente Medical group in birth injury claims stands above the rest. He has prosecuted more birth injury claims under the terms of the Kaiser Arbitration system than any other Northern California attorney. Within the last 36 months he has resolved cases involving FHR monitoring errors, delayed c-section, cerebral palsy, uterine rupture and delayed C-section having a total dollar value over $100,000,000 . Mr. Kelly is currently prosecuting cases involving cerebral palsy, excessive Pitocin administration, fetal monitoring errors, failed vacuum delivery, brain injury, delayed caesarian section and uterine rupture.
In 2010 he was selected for the 16th consecutive year as one of the Best Lawyers In America. He is the only four-time “Trial Lawyer of the Year” nominee of the San Francisco Trial Lawyer’s Association, having most recently won the award in 2010. In 2010 he was also nominated (for a second time) for the prestigious Consumer Attorneys of California “Consumer Attorney of the Year” award. Voted in 2009 by the readers of San Francisco’s Recorder legal newspaper as the “Best Personal Injury Attorney” in San Francisco, he was featured on the cover of the 2009 Northern California Super Lawyers magazine.
He is a summa cum laude graduate of St. Mary’s College of California and obtained his law degree from the University of California, Hastings College of the Law in 1976. Mr. Kelly has successfully prosecuted cases throughout California in both State and Federal Court. He has also litigated matters in Oregon, Hawaii, Colorado, Alaska, Minnesota, New Mexico and the Territory of Guam.
He holds an “AV” rating (highest rating) from Martindale-Hubbell and has been favorably profiled in legal periodicals. He is heavily involved in continuing legal education and teaches for NITA, the California Continuing Education of the Bar, ABOTA, CAOC, SFTLA and The Rutter Group.
