Exactech Issues Recall on Knee Replacement Implants

In February 2022, medical device manufacturer, Exactech®, issued a recall for its knee replacement implants. The recall followed  high-rates of wear and complications due to suspected improper packaging.

In its recall notice Exactech®, said that the recalled knee implants were packaged in “out-of-specification” vacuum bags. The result was the possibility of excessive oxidation of the plastic  inserts that are key components of the device.

Exactech® has sent letters to surgeons who used the devices . It has also notified surgery centers and hospitals  explaining the reasons for the recall. Exactech® has also provided doctors with a template of a notification letter to their patients explaining the recall. If you received a letter from your doctor or hospital or health system call the defective product lawyers at Walkup Melodia today.

Letters were sent to operating surgeons. If you have not received a letter it does not necessarily me you were not implanted with one of these devices. To make certain if you were implanted with a recalled device you will need to obtain and review your medical records. Obtaining  a copy of your operative report from your implanting doctor should reveal the make and model of any prosthesis implanted in your body.

Your family doctor or primary care physicians may not be aware of the recall since letters were not sent to them by Exactech.

Exactech®, has established what it terms  a “Claims Helpline” to encourage victims not to take legal action. The claims hotline advertises the opportunity to seek and obtain “recall-related out-of-pocket expenses” . But victims of injury from recalled products who suffer pain, suffering, disability, or are forced to undergo additional treatment or surgery,  are entitled to more than just out-of-pocket reimbursement under California law.

Victims of recalled product related injury should consult a skilled and experience attorney to learn their rights and options under state law. The defective medical product legal team at Walkup Melodia has represented injured consumers and patients in seeking recovery from manufacturers for more than 40 years.

The Walkup Law is a contingent fee law firm. We offer a free consultation to consumers who have a potential claim arising out of injury from a defective product.
