Walkup bicycle injury attorneys represented a semi-retired surgeon and experienced cyclist who was riding on a designated bike route near his East Bay home when his front wheel fell into a trench at a road construction site. He was thrown over his handlebars, landing headfirst on the asphalt, which broke his neck and left him a quadriplegic.
Although the police initially reported that the cyclist was at fault for riding inside the safety cones, our attorneys demonstrated that construction crew members had moved the cones after the accident and before the scene was photographed. They also secured admissions from the contractor that the site failed to meet minimum safety standards. Through litigation, we showed that proper signage and barricades could have prevented the injury. The case resolved with a $12 million settlement for the cyclist and his spouse.
