Pacific Fertility Negligence – Damaged Embryos and Biologic Tissue

On March 11, 2018, Pacific Fertility Center in San Francisco advised its clients via email of what its president called an “unfortunate incident” in their laboratory. PFC cryo- storage machinery failed to perform as intended, and failed to perform as required under its contract with clients. As a result, embryos, tissue and other genetic material experienced a rise in temperature beyond that which is required by good and accepted practice, as well as facility standards. The loss of liquid nitrogen in the equipment caused unknown damage and harm to PFC clients.

Specific details were not given by Pacific Fertility Center president “Rusty” Herbert. He did not tell purchasers of PFC storage services the full extent of the damage to embryos, unfertilized eggs, sperm, tissue and other material. ABC news in San Francisco reported the problem with the liquid nitrogen in the PFC storage tanks, triggering calls and letters by more than 400 concerned clients and patients.

Herbert’s email was not sent until March 11 at 4:00 a.m. – while the failure is believed to have occurred on March 4 — the same day another cryogenic tank failure was reported in Cleveland, where the University Hospital Fertility Clinic is investigating “an unexpected temperature fluctuation” that jeopardized its tissue storage bank. There has been no explanation as to why there was a 7 day delay in notifying clients and patients with genetic material in the custody of Pacific Fertility Center.
