In February 2022, medical device manufacturer, Exactech®, issued a recall for its knee replacement implants. The recall followed high rates of wear and complications due to suspected improper packaging. Walkup Exactech clients have been forced to undergo additional surgeries because their original artificial joints have failed or been recalled.
In Jan, Exactech’s legal team informed the MDL Judge Garaufis about the progress of consolidating class action MDL in federal court with the consolidated Exactech recall cases in Florida state courts. Exactech is requesting for official coordination between the federal and state court proceedings, as it would result in cost savings for the company. However, the plaintiffs in the Florida state court cases have opposed Exactech’s motion for coordination. The Florida court held a hearing on December 29, 2022, and a verdict is expected to be announced soon.

Recall of Exactech Knee and Ankle Replacement Implants
In its recall letters Exactech® had admitted that the recalled knee implants were packaged in “out-of-specification” vacuum bags. The result was excessive oxidation of the plastic inserts that are key components of the device. Excessive oxidation can cause structural failure. Among the signs that the implant may have failed due to the defective insert include pain and swelling, inability to bear weight and instability in the knee or ankle.
Medical device manufacturers have a legal obligation to ensure that their products are safe. The knee and ankle replacement implants were defective.
Our Exactech knee replacement attorney understands the laws regarding defective products and we know that you deserve the most compensation available in the case of these recalls. Walkup, Melodia, Kelly & Schoenberger have been fighting to recover damages for clients for over 6 decades and know how to help you.
The Exactech knee replacement system has a history of failure. The device itself has been cleared through the FDA 501(k) process to avoid the full PMA review process.
Reports in the FDA’s Manufacturer and User Facility Device Experience (MAUDE) database indicated the devices were failing at an abnormally high rate compared to other implants. As of the end of 2022, there were so many complaints about Exactech implant devices in MAUDE system that cannot show all of the complaints. Complaints and early Exactech Knee Replacement Lawsuit led to investigate possible flaws led to the discovery of the defective vacuum-seal packaging which prompted the recent recall notices.
Exactech® has sent letters to surgeons who implanted the defective devices. It has also notified surgery centers and hospitals where surgeries were done explaining the reasons for the recall. Exactech® has asked doctors to help it avoid legal claims by directing patients with defective prostheses to contact a third-party company – Broadspire – which has been retained by Exactech to convince patients to take less money than state laws require a wrongdoer to pay. Exactech® has established what it terms a “Claims Helpline” to encourage victims not to take legal action. The claims hotline advertises the opportunity to seek and obtain “recall-related out-of-pocket expenses” Don’t settle for less than the law permits you to recover. Victims of injury from recalled products who suffer pain, suffering, disability, or are forced to undergo additional treatment or surgery, are entitled to more than just out-of-pocket reimbursement under California law.
